Uzman çavuşlarımızın 926 sayılı Türk Silahlı Kuvvetleri Personel Kanunu kapsamına alınmalarını sağlayacak, tayinlerinde aile bütünlüğünü dikkate alan düzenlemeleri yapacak ve tüm ordu evlerinden ve sosyal tesislerden istisnasız istifade etmelerini sağlayacağız. Emniyet Genel Müdürlüğü içinde yaşanan kurum içi disiplin soruşturmalarının hukuki temellerden uzak ve keyfi olarak yapılmasını, yönetmeliği yeniden düzenlemek suretiyle engelleyecek, disiplin süreçlerini denetime açacak ve cezai yaptırımları orantılı hale getireceğiz. POLSAN üyeliğinin tüm EGM personeli için zorunlu olması uygulamasını kaldıracağız. Türkiye ile kıyıdaş devletler arasında ikili sınırlandırma kapsamında deniz yetki alanı sınırlandırma anlaşmalarının akdedilmesi için çaba harcanacak, Doğu Akdeniz’de her türlü hak ve hukukumuzun güvence altına alınması ve Münhasır Ekonomik Bölge (MEB) ilan edilmesi hususunda gerekli adımlar atılacaktır. Zorunlu hizmet şartı ile yurt dışına burslu olarak eğitim almaya gönderilenler, ilgili prosedür gereği, yurda dönüşlerinde zorunlu hizmetlerini ifa etmek üzere önceden belirlenmiş olan üniversitelerde göreve başlamaları söz konusu olmaktadır. Bursiyerlerin, burs dönemleri içerisinde olmak kaydıyla, yapmış oldukları evliliklerde, zorunlu hizmetlerini aile bütünlüğünü sağlayacak şekilde yerine getirmelerini sağlayacak düzenlemeyi hayata geçireceğiz. Yalnızca lisansüstü eğitimlerin verileceği ve yüksek katma değerli alanlarla araştırma projelerinin yapılacağı bu enstitülerde, üniversite-sanayi-sivil toplum işbirlikleri yapılacaktır. Başlangıçta seçilecek üç sanayileşmiş ilde Kuracağımız bu enstitüler, kamu üniversitelerine göre daha yüksek bütçeli ve daha özerk bir yapıda olacaktır. Bu enstitülerde lisans eğitimi verilmeyecek olup, akademik personelin özlük hakları ve ücretlerinin yanı sıra, yayın teşvikleri, proje destekleri, patent destekleri gibi faaliyetler üzerinden desteklenmesini sağlayacağız.

Maddeleri olmak üzere 22, 26 ve 48.maddelerine de aykırıdır. Bu haliyle kural öngörülemezdir ve bir kanunda bulunması gerekenöngörülebilirlik ve keyfi müdahalelere karşı güvence içerme niteliklerinitaşımadığından temel hakların kanunla sınırlandırılması ilkesini de ihlaletmektedir. İptali istenen kural içeriğin çıkarılması ve erişiminengellenmesi tedbirlerinden hangisinin hangi koşullarda uygulanacağına dairhiçbir ilke ortaya koymamıştır. Hatta bu tedbirlerin ikisinin aynı andauygulanması mümkünmüş gibi iki tedbir arasına “ve/veya” bağlacı konulmuştur. Şehirlerin ekonomik ve sosyal yönden gelişmesi için özellikle büyükşehir ve il belediyelerine, gelişen ve değişen dünya şartlarına ve teknolojilerine uygun hazırlayacağımız planlarla yön verecek “Şehir Strateji Birimi”ni kuracağız. Yeniden Refah iktidarında, Anayasa ile garanti altına alınan “sağlıklı ve dengeli bir çevrede yaşam hakkı” ilkesine dayalı olarak çevreci, doğal dengeyi koruyan, çevre dostu belediyeleri oluşturacağız. Çiftçilerimizin önemli girdilerinden olan fabrikasyon yem fiyatları çiftçinin kazancını beslerken kaybeder hale getirmekte, küçükbaş hayvan yetiştiriciliği için çok önemli olan meralar, amacı dışında kullanılmakta ve giderek azaltılmaktadır\. Hemen kaydol ve geniş oyun seçeneklerine erişim sağla paribahis\.

Başta ara mallar ve yatırım malları olmak üzere bütün ithal ürünleri ikame edici üretim modelleri öncelikli olarak teşvik edilerek desteklenecektir. İhracatı kolaylaştırmaya ve teşvik etmeye yönelik her türlü tedbir alınacak, gereksiz formaliteler ve istisnalar ortadan kaldırılarak mevzuat bütüncül bir yaklaşımla yerli üretimin artmasını sağlayacak şekilde yeniden hazırlanacaktır. Bu kapsamda girişimcilerimizin yüksek katma değerli üretimi ve ihracatı arttırıcı faaliyetleri faizsiz kredi imkânları ile desteklenecektir. Artan ihracat ve ikame edilen ithalat ile dış ticaret fazlası sağlanacaktır. Sistemi değil insanı merkeze alan, hak ve adalet ekseninde sadece üretim odaklı devleti ve milleti borca esir etmeyen, kendi kaynaklarıyla yatırım, üretim, ihracat yapabilen, istihdam üreterek sürdürülebilir ekonomik büyümeyi temin edecek yeni bir ekonomi inşa edeceğiz. Böylece istikrarlı, güçlü ve dışa bağımlı olmayan bir ekonomik yapı içerisinde bütün vatandaşlarımızın ihtiyaçlarının kolay, bol, ucuz ve kaliteli olarak karşılanabildiği refah toplumuna geçeceğiz. Ekonomi politikalarımızın büyümeyi hızlandırmak adına gerekli sermayeyi hızlı temin etmek için yoğun dış borçlanmaya odaklanılması ve dış kaynaklı sermayenin döviz getirisi olmayan ihracat dışı sektörlere ve özellikle alt yapı yatırımlarına kullanılması ödemeler dengesini bozmuş ve cari açık üreten büyüme modeli oluşmuştur. Böylece başlangıçta tercih olan yüksek faiz düşük kur politikası bir zaruret haline dönüşmüş ve ekonomiyi ağır borç ve borç faizi servisi altına sokmuştur. Kentsel dönüşüm, bilime saygı gösterilerek ve bilimin gösterdiği yol takip edilerek gerçekleştirilecektir. Kentsel dönüşüme odaklanan özel müteşebbislerin, kentsel dönüşüm eğitiminden geçirilmeleri esastır. Ayrıca kentsel dönüşüm projeleri ile sınırlı olmak kaydı ile özel müteşebbislerin finansman destek paketleri teşvik edilmelerini sağlayacağız. Kentsel dönüşümün önemi hakkında bilgi ve farkındalık düzeyini artırmak amacıyla kamu spotları hazırlayacak, ayrıca yeni nesillerimizin bilinçli yetiştirilmesi amacıyla okullarda eğitim programları düzenleyeceğiz.

Fıkraya atıfla birlikte tebliğin hangi yöntemle yapılacağı hususunda birbelirsizlik bulunmaktadır. Bu nedenle kuralın iptal edilerek Anayasal ilkelereuygun şekilde yeniden düzenlenmesi gerektiği görüşündeyim. İçeriğin çıkarılması işleminin uygulanabilmesi için 8. Maddenin(1) numaralı fıkrasında sayılan suçların işlendiğinin Başkan tarafından tespitedilmiş olması gerekli ve yeterli olacaktır. Konuya ilişkin kamuoyunda nefret söylemi kanunu olarak bilinenve pek çok eleştiriye maruz kalan, içerik yönetimine ilişkin ilk düzenlemeSosyal Ağ Kanunu (“NetzDG”) Almanya’da 2017 yılı sonunda kabul edilmiştir.[6] Düzenleme kabul edilmeden önce uzunbir süre tartışılmıştır. Önce 2015 yılında bir çalışma grubu oluşturulmuş vekonusu suç olan içeriklerin yönetimi ve bu konuda nasıl mücadele edilmesigerektiği iki seneden uzun bir süre boyunca bu çalışma grubundadeğerlendirilmiştir.

Rantı önceleyen değil, adil ve hakça paylaşımı önceleyen bir kentsel dönüşümü sağlamak amacıyla yerel yönetimlerle ilgili, başta 5216 sayılı Büyükşehir Belediyesi Kanunu ve 5393 sayılı Belediye Kanunu olmak üzere, 5302 sayılı İl Özel İdaresi ve 5442 sayılı İl İdaresi kanunlarında düzenlemeler yapacağız. 2012 yılında yürürlüğe giren 6306 sayılı Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun’un gerekleri yerine getirilmemiştir. Başta riskli yapı tespitleri olmak üzere kentsel dönüşümü sağlayacak kanun ve yönetmelikler güncellenecek ve sıkı bir disiplin içerisinde uygulanacaktır. Kentsel dönüşümün; deprem, sel felaketi, toprak kayması ve orman yangını gibi doğal afet ve felaketlere hazırlıklı olması için bilimdeki son gelişmelere göre yapılaşma mevzuatını güncelleyecek ve kentsel dönüşümün bu yeni mevzuat çerçevesinde yapılmasını sağlayacağız. Kentsel dönüşümle ilgili mülk sahipleri, yerel yönetimler ve özel müteşebbisler arasındaki uyuşmazlıkları önleyici, adil ve hakça paylaşıma dayalı düzenlemeler getireceğiz. Dava konusu kurallar, internet ortamında yapılanyayınların içeriğinin yayından çıkarılabilmesine ve/veya bu yayınlara erişiminengellenmesine imkân tanımak suretiyle ifade özgürlüğünü ve bu yayının internethaberciliği kapsamındaki bir yayın da olabileceği gözetildiğinde basınözgürlüğünü sınırlamaktadır.

NetzDG ayrıca şeffaflığı sağlamak üzere platformların raporsunmasını öngörmektedir. Bir platform yılda 100’den fazla şikâyet alırsa, altıayda bir içerik denetleme uygulamalarını detaylandıran geniş kapsamlı raporhazırlaması ve yayınlaması gerekmektedir. Yasa, ne tür bilgilerin bu raporlaradahil edilmesi gerektiğini ayrıntılarıyla açıklamaktadır. Şehirlerimizi kısa vadeli şahsi rant ve menfaatlere kurban vermeyeceğiz. Yüz yıl sonrasını düşünerek şehirlerimizi planlayacağız.

Diğer taraftan idari tedbir olarak öngörülen içeriğinçıkarılması tedbirine hangi hallerde başvurulabileceği konusunda dördüncüfıkrada herhangi bir açıklık bulunmaktadır. Tanımda yer alan “sosyal etkileşim”, “oluşturma”, “görüntüleme”ve “paylaşma” gibi kavramlar da hukuken belirsizdir. Şehirlerde en uygun yükseklikte yatay şehirleşmeyi yaygınlaştıracak, iyileştirme projelerini uygulayacağız. “Sosyal Devlet Projesi” anlayışıyla, evi olmayan en alt gelir düzeyindeki ailelere her yıl belirli sayıda sosyal konut yapacağız. Yeniden Refah iktidarında; tarihi ve doğal doku korunacak, estetiği olan şahsiyetli şehirler oluşturacağız. Ahlaki ve manevi açısından da şehrin, arsanın ve toprağın rant unsuru olmaktan çıkarılmasını sağlayacağız. Rantın önüne geçmek için kentsel dönüşüm alanlarında ve diğer alanlarda fiyat denetim mekanizması geliştireceğiz. “Riskli Alan” kavramı, adalet ve hakkaniyet ölçülerine göre yeniden tanımlanacaktır. Kentsel dönüşümde riskli alanlarda yaşayanların, mahalli yönetimlerin, STK ve meslek odalarının sürece katılmasını sağlayacağız. Şehirlerin geleceği, medeniyetin geleceği olarak ele alınmak suretiyle mahalle kültürünü, komşuluk ilişkilerini ve geleneksel mimari kültürümüzü koruyacak ve geliştireceğiz.

Bütün kaynaklar yüksek katma değerli mal ve hizmetlerin üretiminde, nitelikli istihdamın ve yüksek teknoloji ihracatının desteklenmesinde kullanılacaktır. Konutlarda kullanılan elektriğin fiyatlamasındaki çarpanların yeniden belirlenmesini ve faturalara yansıtılan harcama dışındaki yükün (kayıp kaçak, okuma bedeli, vb.) kaldırılmasını sağlayacağız. Yurtdışından satın alınan enerji birimlerinin tamamında, ödemeleri kademeli olarak döviz cinsinden ayırıp, yerli ürünlerimizle Barter (Takas) sistemine esas alan bir karşılıklı ödeme sistemi geliştireceğiz. TOKİ konutlarının, kentlerin uzak bölgelerinde, yerleşimin nispeten düşük olduğu kamu arazileri üzerinde yapılıyor olması, bu projelerden haberdar olan yerel ve merkezi siyasi aktörlerin erken davranıp bu civardaki arazi ve arsaları ucuzken almalarına sebep olabilmektedir. Böylece konutların yapılması ile beraber cazibe merkezi haline gelen bu alanlardaki arsa rantları vatandaştan ziyade siyasi aktörlere aktarılmaktadır. Bunun önüne geçmek için proje yapılacak alanda TOKİ projelerinden habersiz satış yapan vatandaşlarımız, Tapu Dairelerinde satıştan önce bilgilendirilecektir. Ayrıca projelerin çizilmesiyle birlikte tüm kamuoyuna bilgilendirme yapılacaktır. Böylece haksız rantın ve tek taraflı zenginleşmenin önüne geçilecek, kamunun gerçek değerler üzerinde vergilendirme yaparak vergi geliri elde etmesi yoluyla gelir dağılımında adaletin sağlanmasında verim artırılacaktır. Belirtilengerekçelerle dava konusu kuralların Anayasa’nın 2., 9., 36. Maddelerineaykırı olduğu sonucuna ulaştığımdan çoğunluk kararına katılmıyorum. Bu itibarla teşebbüsözgürlüğüne sınırlama getiren kuralın belirli, ulaşılabilir ve öngörülebilirnitelikte olduğu, dolayısıyla kanunilik ölçütünü sağladığı anlaşılmaktadır.

Anılan fıkrada yer alan “…içerik, yer ve erişim sağlayıcılarınsorumluları,…” ibaresi de dava konusu diğer kuralı oluşturmaktadır.
